1. Scope of Services
Sky Pro Claims assists clients in pursuing compensation and/or reimbursement related to airline disruptions, including but not limited to:
Flight delays and cancellations
Denied boarding
Lost, delayed, or damaged baggage
Other entitlements under applicable laws (e.g., EC Regulation 261/2004, Montreal Convention, UK261, Israeli ASL, etc.)
Sky Pro Claims will represent all passengers listed under the booking provided in the claim submission.
2. No Win, No Fee
Sky Pro Claims operates on a contingency fee basis:
No compensation = no fee.
If no monetary recovery is secured, the Client owes nothing.
3. Success Fee
If compensation is successfully recovered, Sky Pro Claims is entitled to a fee of:
30% of the gross compensation amount (inclusive of VAT, where applicable).
This amount will be deducted from the compensation before payment is made to the Client.
If the airline issues a non-cash form of compensation (e.g., travel voucher), alternative fee terms may apply, and will be communicated in advance.
4. Client Consent and Authorization
By submitting a claim, you:
Authorize Sky Pro Claims to act on your behalf with airlines, legal bodies, and third parties involved in the dispute.
Confirm that you have not authorized any other third party to pursue the claim.
Agree to refrain from accepting direct payment from the airline or settling the claim independently after Sky Pro has initiated the claim.
If required, you agree to sign any additional documents (such as a Power of Attorney or Assignment of Rights) necessary to pursue the claim.
5. Termination
Either party may terminate the agreement at any time by written notice.
However:
If Sky Pro has already recovered compensation, the Client remains liable for the 30% success fee.
If substantial efforts were made by Sky Pro prior to termination and compensation is later recovered, Sky Pro reserves the right to claim its fee.
6. Limitation of Liability
Sky Pro Claims will exercise reasonable care and skill, but cannot guarantee the outcome or timing of any claim.
Sky Pro’s liability is limited to the amount of the service fee received for the specific claim.
7. Entire Agreement
These Terms & Conditions constitute the entire agreement between the Client and Sky Pro Claims and supersede any prior agreements or understandings.
By submitting a claim via our website, you agree to these terms on behalf of yourself and all passengers included in the booking.
8. Governing Law
This Agreement is governed by the laws of the State of New York, USA.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in New York County.
